1) General Terms and Conditions
All methods of sale, delivery, and payment are thoroughly described in the various sections of the PROFORMA Model related to the order, forming an integral and essential part of these Terms and Conditions.

The terms and conditions for each order are those indicated on the Website at the time of purchase. Any changes to the terms will be valid from the date of their publication and will apply exclusively to orders placed thereafter.

2) Offer to the public
All products and prices listed on the Website constitute a public offer subject to the limitations and terms set forth on the Website and in these General Terms and Conditions of Sale.
All prices included in this agreement are VAT inclusive. Prices may be changed at any time without prior notice. Acceptance of this agreement establishes a binding commitment between the seller and the buyer regarding the agreed prices and delivery/shipping methods. Only the quotation received by email shall be considered valid as a price agreement between the parties (not binding for purchase) and will remain valid (upon confirmation) for 7 days from the date of request, in accordance with the Terms and Conditions.

Please note that all photos are for illustrative purposes only. As these are handmade products, variations in decorations and colors may occur.

3) Prices and Deliveries
The prices indicated on the website are ‘list prices‘, with discounts applied according to contractual agreements. Once the contract is accepted, the discounts will not be subject to change.

Deliveries are made within 3–5 working days for products ready for shipment and up to 30 days for those made to order. Delivery times are respected as per contract, and we keep Customers informed about the progress of their order.

For shipments within Europe, delivery times depend on the courier, while for deliveries outside the EU, costs vary according to the destination. Any customs duties are the responsibility of the Customer.

We are not responsible for delays or disruptions caused by force majeure (such as bad weather, strikes, or accidents). In case of any issues, the Customer may contact us directly.

4) Order Acceptance and Confirmation

The order submitted by the Customer will be binding on Arte in Ceramica only if:

• the entire order procedure has been completed properly
• without any error messages being displayed
• The Customer will receive an order confirmation in their email inbox.
• has checked the box during the payment process to accept the Terms and Conditions

5) Order Cancellation and Modification
Arte in Ceramica, due to unforeseen logistical and organizational difficulties, may cancel the order by notifying the Customer via e-mail or, subject to the Customer’s agreement, may modify the delivery date and/or time.

6) Product Availability and Purchase Limitations
Arte in Ceramica shall not be held liable in any way for the temporary or permanent unavailability of one or more products. In the event of unavailability, even temporary, of the requested products, Arte in Ceramica undertakes to meet the Customer’s needs as quickly as possible. Should a product be unavailable, Arte in Ceramica will provide the Customer (after prior notice) with a similar product of equal or greater value.

7) Failed Delivery
For delivery, the presence of the Customer or an authorized representative at the address and time indicated in the order is required. If the Customer (or the authorized person) is not present, a second delivery attempt will be made and the shipment will be placed in storage. Storage costs at the courier’s warehouse shall be borne by the purchaser. The maximum storage period is 2 days; beyond this limit, the Customer will be charged the costs incurred by Arte in Ceramica for the failed delivery and return of the package. After that, Arte in Ceramica will contact the Customer to arrange a new shipment (at the Customer’s expense). Arte in Ceramica also reserves the right to exclude the Customer from the service.

8) Payment
The Customer may pay for the purchase using the following methods:
Bank Transfer, PayPal, Google Pay, Apple Pay, Credit Cards.
The Customer is required to make the payment within 5 days of the acceptance of the contract and must send a copy of the completed payment via email.
The bank transfer must be made to the bank account details provided at the time of purchase.
The transfer must include, as a reference, the invoice or proforma number and the date.

9) Right of withdrawal

1. The Customer’s rights are protected under Legislative Decree 206/2005, as updated by Legislative Decree 21/2014, and form an integral part of these terms and conditions.
2. The Customer may withdraw from the contract, in whole or in part, without providing any explanation and without additional costs, by notifying us via email within 14 days from the receipt of the product. The request must clearly state the withdrawal and the product concerned, and must include a copy of the invoice.
3. If the delivery has already taken place, the Customer must return the products at their own expense within 14 days, marking the package with “order return.” Returns with cash on delivery or freight collect will not be accepted. Arte in Ceramica will refund the amount paid within 30 days, excluding shipping costs.
4. All products are handmade and hand-painted, and therefore may slightly differ from the images shown. Any imperfections (such as small dots or spots) will, whenever possible, be harmonized with small decorative details, with prior notification to the Customer via email.
   The right of withdrawal is not permitted in the following cases:
5. purchase of products that have been tampered with by the Customer.
   Products must be returned in the same condition in which they were received by the Customer, placed in their original packaging and complete with all accompanying materials.
6. products that show obvious signs of use
7. for reasons attributable to packaging defects that were not reported to the courier at the time of delivery
8. for all products that are part of the “made-to-measure or personalized” services and products

10) The Website’s Intellectual Property

This includes texts, images, and graphics, which are the property of Ceramic Art. All rights related to the use of the trademark, the ownership of the trademark itself, as well as the products and services featured on the Website, are owned by Ceramic Art. Any unauthorized reproduction, even partial, will be prosecuted according to the law.

11) Privacy

Ceramic Art will process the Customer’s personal data in compliance with privacy regulations, as detailed in the Privacy Policy section of the Website.
